Circular No 296/2010
Dated 24 Dec 2010

To all Members of the Malaysian Bar

Directory of all Chiefs of District Criminal Investigation Department

Bar Council, through its Criminal Law Committee, has been engaging with the Royal Malaysian Police Force (“RMP”) and Attorney General’s Chambers (“AGC”) at tripartite meetings that take place about once every three months. One of the key issues under discussion is section 28A of the Criminal Procedure Code (Act 593) (“CPC”).

According to RMP, a directive on section 28A of CPC was issued to all District Chiefs of Police on 9 Sept 2010. The directive spells out the rights of a detained person to meet with a counsel of his or her choice in lock-up. In the event a private consultation room is unavailable for this purpose, RMP must grant the detained person and his or her counsel the privilege of having a private conversation.

If the directive is being violated, Members are strongly encouraged to lodge written complaints to the relevant Chief of District Criminal Investigation Department. A directory of the contact details of all Chiefs of District Criminal Investigation Department in Malaysia is attached.

Should you have any queries or require additional information, kindly contact Lim Ka Ea, Executive Officer, Bar Council Criminal Law Committee, by telephone at 03-2031 3003 ext 127 or by email at kaea@malaysianbar.org.my.

Thank you.
